"It's an incomplete claim, there are no facts to support the allegation," said Sara Najjar, a NASA assistant general counsel. She said the $21.1 million damage claim is the only one from the disaster filed to date. The fisherman, John Kipalani, told reporters yesterday he was steering his shrimp boat and his son was sleeping below deck, when "I heard a racket on the boat that attracts me. When I cast my eye around the left side I see a large round piece of metal 1 stick up like scissors in the boat and the boat was busting in two." Kipalani said he was 53 miles off the coast of North and 1 South Carolina and 1 Georgia at the time.
"I just got up and threw myself into the Atlantic Ocean," he said. The boat sank, but he got into one of the boat's two rubber dinghies that floated by.
